Terms of Service

These Terms govern your use of the Peeble application (the "Application" or "Service") and your subscription to the paid Peeble+ offer. They form a contract between you ("User") and the publisher of Peeble.

Please note that Peeble is operated from France by a French sole proprietor. The Service is governed by French law, regardless of where you reside. If you are a consumer in another EU country, you also benefit from the mandatory protections of your local consumer law.

3. Definitions

  • Service / Application: the Peeble platform (iOS and Android mobile apps, associated website) for creating, organizing and sharing geolocated travel guides.
  • User: any individual aged 15 or older using the Application.
  • Account: the User's personal space, created by signing up via email, Google Sign-In or Apple Sign-In.
  • User Content: any text, photo, video, voice note, place, list or guide created or uploaded by the User.
  • Peeble+: the paid subscription offer providing access to extended features (higher quotas, collaboration, voice, generative AI).
  • Distribution Platform: the Apple App Store or Google Play Store, through which the Application is distributed and subscriptions are sold.

4. Acceptance of Terms

Using the Application implies full acceptance of these Terms. By creating an account, signing in, or subscribing to Peeble+, you acknowledge that you have read these Terms and accept them without reservation.

If you do not accept these Terms, you must not use the Service.

5. Eligibility

The Service is open to individuals aged at least 15 years old, in accordance with French data protection law. Children under 15 may not create an account. For minors aged 15 to 18, parental consent is required for any paid subscription.

You declare that you have the legal capacity required to enter into this contract. Use of the Service from countries subject to international sanctions may be restricted.

6. Account creation and management

  • You agree to provide accurate information and to keep it up to date.
  • You are solely responsible for the confidentiality of your login credentials.
  • An Account is strictly personal. Creating multiple Accounts to bypass freemium quotas is prohibited.
  • You may delete your Account at any time from the Application settings. Deletion is final and irreversible.

7. Service description

Peeble offers two access tiers:

  • Peeble (free): access to creating guides, lists and places, within monthly quotas (3 explored zones per month, 10 messages with Peeble Guide per month, max 5 lists, etc.). Exact quotas are disclosed in the Application and may change.
  • Peeble+ (paid): extended access without the above limits, collaborative features, voice mode, and unlimited access to Peeble Guide (conversational travel assistant).

The Service is provided "as is". Most features require an Internet connection.

8. Subscribing to Peeble+

Peeble+ is an auto-renewing subscription, sold through the Distribution Platforms (Apple App Store or Google Play Store). By subscribing, you enter into a contract with Peeble for the provision of the Service; payment is processed by the Platform.

8.1. Subscription plans

  • Monthly: monthly billing, automatic renewal at the end of each month.
  • Annual: yearly billing in a single payment, automatic renewal at the end of each year.

8.2. Pricing

Prices are displayed in the Application at the time of purchase, in your local currency, taxes included. Prices may vary by region and by Distribution Platform policy.

8.3. Payment

Payment is processed through the Distribution Platform. Apple or Google handles the transaction and retains a commission. Peeble does not receive or store any payment data.

8.4. Auto-renewal

In accordance with French Consumer Code articles L215-1 et seq., your subscription automatically renews at the end of each period unless you cancel at least 24 hours before the end of the current period.

You can disable auto-renewal at any time:

  • iOS: Settings > [your name] > Subscriptions > Peeble > Cancel subscription
  • Android: Google Play Store > Profile > Payments and subscriptions > Subscriptions > Peeble > Cancel subscription

8.5. Right of withdrawal

Pursuant to article L221-28, 13° of the French Consumer Code, the right of withdrawal under article L221-18 does not apply to the supply of digital content not provided on a tangible medium when performance has begun with the User's prior express consent and express waiver of their right of withdrawal.

By subscribing to Peeble+, you acknowledge that the Service will be made available to you immediately upon payment, and you expressly waive your 14-day right of withdrawal.

8.6. Refunds

Refund requests must be addressed directly to the Distribution Platform:

Peeble has no power to grant or refuse a refund. Our support is however available to assist you: contact@allkemix.com.

For purchases made via Google Play, Google applies an automatic refund policy within 48 hours of purchase. Beyond that window, refunds are granted by Peeble on a case-by-case basis, at its sole discretion, after contact at hello@allkemix.com.

9. Legal warranties

Under French law, the Service benefits from:

  • the legal warranty of conformity (Consumer Code, articles L217-3 et seq.);
  • the warranty against hidden defects (Civil Code, articles 1641 et seq.).

No additional commercial warranty is offered by Peeble.

10. Customer support and complaints

For any question, complaint or request relating to the Service, contact us at: contact@allkemix.com. We aim to respond within a reasonable time, on average within 5 business days.

11. Consumer mediation

Pursuant to article L612-1 of the French Consumer Code, in the event of an unresolved dispute after a written prior complaint to our customer support, you may freely refer the matter to a consumer mediator.

Peeble is currently in the process of joining a mediator approved by the French Commission for Consumer Mediation Evaluation and Control (CECMC). The mediator's contact details will be published in this section as soon as the registration is finalized.

In addition, you can use the European Online Dispute Resolution platform (ODR) at any time: ec.europa.eu/consumers/odr.

12. User Content and licence

You retain ownership of your User Content (texts, photos, videos, voice notes, places, lists, guides). You are solely responsible for its legality, accuracy and compliance with third-party rights (copyright, image rights, privacy).

By publishing User Content on Peeble, you grant Peeble a non-exclusive, worldwide, royalty-free and transferable licence to host, reproduce, display, technically adapt and distribute that content, solely for the purpose of operating the Service. This licence ends upon deletion of the content or your Account, subject to temporary technical backups.

13. Moderation and reporting

The following are strictly prohibited on Peeble:

  • illegal content (incitement to hatred or violence, glorification of terrorism, child sexual abuse material);
  • defamatory, abusive, threatening content or content infringing the privacy of others;
  • infringing content or content violating intellectual property rights;
  • unsolicited commercial content, spam, manipulation of the Service.

Any User can report unlawful content using the in-app reporting feature or by email at contact@allkemix.com. We process reports within a reasonable time, in line with our obligations under the Digital Services Act (DSA).

Peeble reserves the right to remove any manifestly unlawful content and to suspend or terminate the Account of any User in case of repeated violations.

14. Peeble's intellectual property

Excluding User Content, all elements of the Service (logos, texts, trademarks, source code, design, databases, features) are the exclusive property of Peeble or its partners, and are protected by French and international intellectual property law.

Any reproduction, representation, modification, exploitation or substantial extraction, in whole or in part, without prior written authorization, is prohibited and constitutes infringement punishable under articles L335-2 et seq. of the French Intellectual Property Code.

15. Personal data

The processing of your personal data is detailed in our Privacy Policy, which forms an integral part of these Terms.

16. Liability

Peeble does its best to ensure the availability and reliability of the Service, but cannot guarantee complete absence of interruption, error or data loss. Information displayed in Peeble Guide (conversational assistant) is generated by artificial intelligence and may contain inaccuracies; it is provided for informational purposes only.

Peeble cannot be held liable for:

  • User Content published by other users;
  • indirect damages resulting from the use of the Service;
  • temporary unavailability for maintenance or in case of force majeure;
  • the behaviour of Distribution Platforms (Apple, Google).

Under French law, Peeble's liability cannot be limited in cases of intentional misconduct, gross negligence, bodily injury or breach of mandatory consumer-protection rules.

17. Suspension and termination by Peeble

Peeble may suspend or terminate your Account, with or without notice, in case of:

  • serious or repeated breach of these Terms;
  • publication of unlawful User Content;
  • attempt at fraud or circumvention of the Service.

In the event of termination for cause, no refund of the Peeble+ subscription is due.

18. Modification of the Terms

Peeble reserves the right to modify these Terms at any time. Substantial modifications will be notified to you by email or by in-app notification at least 30 days before they take effect. Continued use of the Service after that date constitutes acceptance. If you do not accept the new Terms, you can terminate your Account.

19. Governing law and jurisdiction

These Terms are governed by French law.

In the event of a dispute, and after attempting amicable resolution (customer support + mediation), French courts shall have jurisdiction. In accordance with article R631-3 of the French Consumer Code, the consumer may, at their choice, bring proceedings before the court of the place where they resided at the time of conclusion of the contract or of the occurrence of the harmful event.
